Bostel CRM – SMS/MMS Campaign Terms of Service

1. Introduction

These SMS/MMS Terms of Service (“Terms”) govern the use of text messaging services provided by Bostel CRM (“the Company,” “we,” “our,” or “us”). By enabling, opting in, or using SMS/MMS features—including sending quotes, invoices, billing notices, appointment reminders, alerts, and marketing messages—you (“User,” “Customer,” or “Subscriber”) agree to these Terms.

2. Purpose of SMS/MMS Communication

Bostel CRM provides SMS/MMS services to allow businesses to communicate directly with their customers. This may include:
• Quotes, invoices, and billing notifications
• Appointment confirmations and reminders
• Customer service alerts
• Marketing campaigns (where legally permitted)
• Account and system notifications

Each business using Bostel CRM is responsible for complying with federal, state, and carrier-level regulations.

3. User Responsibilities

Users agree to:
1. Obtain all legally required consent from their contacts prior to sending SMS/MMS messages.
2. Maintain records proving consent for opt-in messaging.
3. Include opt-out language where required (“Reply STOP to unsubscribe”).
4. Use SMS/MMS services in a lawful, ethical, and respectful manner.

4. Message Frequency

Message frequency varies depending on the business and user interactions.

5. Opt-In Requirements

Users must ensure individuals knowingly opt in. Website, form, paper, or verbal opt-ins must follow TCPA and CTIA rules.

6. Opt-Out Instructions

Recipients may opt out anytime by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. Bostel CRM prevents further messaging immediately.

7. Fees and Charges

Standard carrier messaging rates may apply. Bostel CRM is not responsible for carrier fees.

8. Prohibited Use

Users may NOT send:
• Unsolicited spam
• Fraudulent or deceptive messages
• Illegal product promotions
• Hate speech or harassment
• Adult or sexual content
• Protected health information without compliance
Violations may result in suspension.

9. Data Handling and Retention

Message logs and metadata may be stored for compliance. Retention varies based on legal requirements.

10. System Availability

Delivery is dependent on wireless carriers. Bostel CRM cannot guarantee delivery performance.

11. Privacy and Security

All SMS/MMS data is handled under Bostel CRM’s Privacy Policy.

12. Termination and Suspension

We may suspend services for violations, illegal use, or carrier‑mandated restrictions.

13. Changes to These Terms

Updates may occur. Users will be notified via the CRM.
